By accessing or using the website at www.watsonvilleasphaltpaving.com (the "Site"), or by requesting or receiving services from Watsonville Asphalt Paving ("we," "us," or "our"), you agree to be bound by these Terms and Conditions. If you do not agree, please do not use this Site or engage our services.
Watsonville Asphalt Paving provides asphalt paving, sealcoating, repair, striping, and related services in Watsonville, CA and surrounding communities. The information on this Site describes our services in general terms. Specific scope of work, materials, and timelines are governed by the written estimate or agreement provided to you for each individual project.
Estimates provided by Watsonville Asphalt Paving are based on a site visit and the information available at the time of the estimate. An estimate is not a binding contract until both parties have signed or otherwise confirmed the work order in writing.
Final pricing may change if site conditions differ materially from what was observed at the time of the estimate, if the scope of work changes at the customer's request, or if unforeseen conditions are discovered during the work. We will communicate any material price changes before proceeding with additional work.
Scheduling is subject to crew availability, weather conditions, and other operational factors. We will make reasonable efforts to complete work on the agreed date. Weather, equipment issues, or other factors outside our control may require rescheduling, and we will notify you as promptly as possible when that happens.
If you need to cancel or postpone a scheduled job, please contact us as soon as possible. Cancellations made with sufficient advance notice will generally not incur a fee. Cancellations made after materials have been ordered or after a crew has been dispatched may result in a charge for materials and/or mobilization costs. Specific cancellation terms will be stated in your written work agreement.
Payment terms are set out in the written estimate or work agreement for each project. A deposit may be required before work begins. The remaining balance is due upon completion of the work unless other terms have been agreed to in writing.
Invoices not paid by the due date may be subject to a late fee. We reserve the right to suspend or refuse further work on properties where outstanding invoices remain unpaid. Returned checks and failed payments may result in additional fees.
Watsonville Asphalt Paving stands behind our workmanship. Any specific workmanship warranty will be stated in your written work agreement. Unless expressly stated in that agreement, we make no warranties beyond what is explicitly set out there.
Asphalt and related materials are subject to natural weathering, ground movement, and wear over time. Our workmanship warranty does not cover damage caused by factors outside our control, including extreme weather events, tree root intrusion, ground settlement, improper use, or failure to follow maintenance recommendations.
The information on this Site is provided for general informational purposes only. We make no warranties, express or implied, regarding the accuracy or completeness of any information on the Site.
To the fullest extent permitted by applicable law, Watsonville Asphalt Paving shall not be liable for any indirect, incidental, consequential, or punitive damages arising out of or related to the use of this Site or the services we provide, even if we have been advised of the possibility of such damages.
Our total liability to you for any claim arising out of or related to a specific service project shall not exceed the total amount paid by you for that project.
You are responsible for providing accurate information about your property and project when requesting an estimate. You are also responsible for ensuring that the work area is accessible on the scheduled date - this includes moving vehicles, removing obstacles, and ensuring that any underground utilities in the work area have been properly located and marked prior to excavation or grading work.
California law requires property owners and contractors to contact Underground Service Alert (USA North or USA South) for utility location before digging. We comply with this requirement on our end, but you are responsible for informing us of any known underground features on your property that may not appear in public utility records.

If a dispute cannot be resolved informally, you and Watsonville Asphalt Paving agree to first attempt mediation in Watsonville, California before pursuing litigation. Nothing in this section prevents either party from seeking emergency or injunctive relief from a court of competent jurisdiction.
These Terms and Conditions are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any legal action relating to these terms or our services shall be brought in the appropriate courts located in California.
